TO: SKILLS CANADA - NOVA SCOTIA and its officers, directors, agents, employees, former employees, staff, representatives, contractors, subsidiaries, successors and assigns, and all related and affiliated corporations, and their officers, directors, agents, employees, successors (all of whom are hereinafter collectively referred to as the "Releasee").

1. DEFINITIONS**

“Competition” shall mean the Nova Scotia Skills Competition that occurs between March 2026 and May 2026 and shall include all activities, events, and services provided, arranged, organized, conducted, sponsored or authorized by the Releasee whether on or off Site, virtual or in person, and shall include but is not limited to: skills whether in person or virtual and whether supervised or not supervised, accommodation, food services, recreational activities, transportation, and ancillary services.
“Sites” shall include all locations where the Competition occurs in person or virtually.

I have carefully read and fully understand and agree to the terms of this Agreement on behalf of my child.

2. Description and Assumption of Risks**

I am aware that my child’s attendance at the Sites and participation in the Competition involves risk, dangers and hazards including, but not limited to: bodily injury or illness; being exposed to or contracting Covid-19 or other infectious diseases, permanent disability, paralysis, loss of life; collision with natural or manmade objects; dangers arising from adverse weather conditions; imperfect venue or skill conditions; equipment failure; participants of varying skill levels; inadequate safety measures; circumstances known, unknown or beyond the control of the Releasee; negligence or omission of the Releasee and loss or damage to my tools (collectively, the “Risks”).

I freely assume all Risks, and anything incidental to the Risks, which may arise as a result of participation in or in connection with the Competition or my attendance at the Sites on behalf of my child.

3. Release of Liability and Waiver of Claims**

In consideration of the Releasee allowing my child to attend the Sites and to participate in the Competition, I hereby agree TO WAIVE ANY AND ALL CLAIMS that I have or may in the future have against THE RELEASEE and TO RELEASE THE RELEASEE from any and all liability for any loss, damage, illness, sickness, expense or injury including death that I may suffer or that my next of kin may suffer as a result of the Risks at the Sites or the Risks from participating in the Competition or both, DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING ANY DUTY OF CARE OWED UNDER THE OCCUPIERS LIABILITY ACT, ON THE PART OF THE RELEASEE. I UNDERSTAND THAT NEGLIGENCE INCLUDES FAILURE ON THE PART OF THE RELEASEE TO TAKE REASONABLE STEPS TO SAFEGUARD OR PROTECT ME FROM THE RISKS REFERRED TO ABOVE.

I have carefully read and fully understand and agree to the terms of this Agreement, on behalf of my child.

4. INDEMNIFICATION**

I FURTHER AGREE TO HOLD HARMLESS AND INDEMNIFY THE RELEASEE FROM ANY AND ALL LIABIILTY, CAUSES OF ACTION, CLAIMS, JUDGMENTS, COSTS AND EXPENSES (INLCUDING LEGAL FEES) THAT ANY THIRD PARTY MAY SUFFER AS THE RESULT OF MY CHILD’S ATTENDANCE AT THE SITES OR MY CHILD’S PARTICIPATION IN THE COMPETITION.
I further agree that if I, or anyone on my Child’s behalf, makes claim against the Releasee, I will indemnify, save, and hold harmless the Releasee from any litigation expenses, legal fees, loss, liability, damage, or cost which the Releasee may incur as the result of such claim.

I have carefully read and fully understand and agree to the terms of this Agreement.

5. GENERAL*

• This Release Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives, in the event of my death or incapacity.
• This Release Agreement shall be governed by the laws of Nova Scotia and any litigation involving the parties to this Release Agreement shall be brought solely within the jurisdiction of Nova Scotia and shall be within the exclusive jurisdiction of the Courts of the Province of Nova Scotia.
• I expressly agree that this Agreement is intended to be as broad and inclusive as is permitted by applicable laws, and that if any portion of this Agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.
• I am not relying on any oral or written representations or statements made by the Releasee other than what is set forth in this Release Agreement.
• I have had an opportunity to review this Release Agreement with advisors of my choosing including legal counsel.
• This Agreement may be executed, made and delivered electronically.

I have carefully read and fully understand and agree to the terms of this Agreement.

Disclosure of Information*

I understand and agree that information pertaining to participation in the Competition, including but not limited to names, occupation, status as a student or apprentice, and standings in the Competition may be shared with or released to the media for coverage of the event. I also agree that photographs and videos taken during the Competition may be used and reproduced by Skills Canada – Nova Scotia and its partners in media, promotional materials and bulletins.

I decline to have photographs and videos of my child used and reproduced by Skills Canada – Nova Scotia and its partners in media, promotional materials and bulletins.

I CONFIRM THAT I HAVE READ AND UNDERSTAND THIS RELEASE AGREEMENT AND I AM AWARE THAT BY SIGNING THIS RELEASE AGREEMENT I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, ASSIGNS AND REPRESENTATIVES MAY HAVE AGAINST THE RELEASEE.

IF I AM SIGNING ON BEHALF OF A CHILD, I UNDERSTAND THIS RELEASE AGREEMENT IN ITS ENTIRETY APPLIES TO BOTH ME AND THE CHILD. I am the Child’s parent and/or legal guardian. I have the legal right to consent to and, by signing below, I hereby do consent to the terms and conditions of this Release Agreement.
